0001 Creative Commons Legal Code 0002 0003 CC0 1.0 Universal CREATIVE COMMONS CORPORATION IS NOT A LAW FIRM AND DOES 0004 NOT PROVIDE LEGAL SERVICES. DISTRIBUTION OF THIS DOCUMENT DOES NOT CREATE 0005 AN ATTORNEY-CLIENT RELATIONSHIP. CREATIVE COMMONS PROVIDES THIS INFORMATION 0006 ON AN "AS-IS" BASIS. CREATIVE COMMONS MAKES NO WARRANTIES REGARDING THE USE 0007 OF THIS DOCUMENT OR THE INFORMATION OR WORKS PROVIDED HEREUNDER, AND DISCLAIMS 0008 LIABILITY FOR DAMAGES RESULTING FROM THE USE OF THIS DOCUMENT OR THE INFORMATION 0009 OR WORKS PROVIDED HEREUNDER. 0010 0011 Statement of Purpose 0012 0013 The laws of most jurisdictions throughout the world automatically confer exclusive 0014 Copyright and Related Rights (defined below) upon the creator and subsequent 0015 owner(s) (each and all, an "owner") of an original work of authorship and/or 0016 a database (each, a "Work"). 0017 0018 Certain owners wish to permanently relinquish those rights to a Work for the 0019 purpose of contributing to a commons of creative, cultural and scientific 0020 works ("Commons") that the public can reliably and without fear of later claims 0021 of infringement build upon, modify, incorporate in other works, reuse and 0022 redistribute as freely as possible in any form whatsoever and for any purposes, 0023 including without limitation commercial purposes. These owners may contribute 0024 to the Commons to promote the ideal of a free culture and the further production 0025 of creative, cultural and scientific works, or to gain reputation or greater 0026 distribution for their Work in part through the use and efforts of others. 0027 0028 For these and/or other purposes and motivations, and without any expectation 0029 of additional consideration or compensation, the person associating CC0 with 0030 a Work (the "Affirmer"), to the extent that he or she is an owner of Copyright 0031 and Related Rights in the Work, voluntarily elects to apply CC0 to the Work 0032 and publicly distribute the Work under its terms, with knowledge of his or 0033 her Copyright and Related Rights in the Work and the meaning and intended 0034 legal effect of CC0 on those rights. 0035 0036 1. Copyright and Related Rights. A Work made available under CC0 may be protected 0037 by copyright and related or neighboring rights ("Copyright and Related Rights"). 0038 Copyright and Related Rights include, but are not limited to, the following: 0039 0040 i. the right to reproduce, adapt, distribute, perform, display, communicate, 0041 and translate a Work; 0042 0043 ii. moral rights retained by the original author(s) and/or performer(s); 0044 0045 iii. publicity and privacy rights pertaining to a person's image or likeness 0046 depicted in a Work; 0047 0048 iv. rights protecting against unfair competition in regards to a Work, subject 0049 to the limitations in paragraph 4(a), below; 0050 0051 v. rights protecting the extraction, dissemination, use and reuse of data 0052 in a Work; 0053 0054 vi. database rights (such as those arising under Directive 96/9/EC of the 0055 European Parliament and of the Council of 11 March 1996 on the legal protection 0056 of databases, and under any national implementation thereof, including any 0057 amended or successor version of such directive); and 0058 0059 vii. other similar, equivalent or corresponding rights throughout the world 0060 based on applicable law or treaty, and any national implementations thereof. 0061 0062 2. Waiver. To the greatest extent permitted by, but not in contravention of, 0063 applicable law, Affirmer hereby overtly, fully, permanently, irrevocably and 0064 unconditionally waives, abandons, and surrenders all of Affirmer's Copyright 0065 and Related Rights and associated claims and causes of action, whether now 0066 known or unknown (including existing as well as future claims and causes of 0067 action), in the Work (i) in all territories worldwide, (ii) for the maximum 0068 duration provided by applicable law or treaty (including future time extensions), 0069 (iii) in any current or future medium and for any number of copies, and (iv) 0070 for any purpose whatsoever, including without limitation commercial, advertising 0071 or promotional purposes (the "Waiver"). Affirmer makes the Waiver for the 0072 benefit of each member of the public at large and to the detriment of Affirmer's 0073 heirs and successors, fully intending that such Waiver shall not be subject 0074 to revocation, rescission, cancellation, termination, or any other legal or 0075 equitable action to disrupt the quiet enjoyment of the Work by the public 0076 as contemplated by Affirmer's express Statement of Purpose. 0077 0078 3. Public License Fallback. Should any part of the Waiver for any reason be 0079 judged legally invalid or ineffective under applicable law, then the Waiver 0080 shall be preserved to the maximum extent permitted taking into account Affirmer's 0081 express Statement of Purpose. In addition, to the extent the Waiver is so 0082 judged Affirmer hereby grants to each affected person a royalty-free, non 0083 transferable, non sublicensable, non exclusive, irrevocable and unconditional 0084 license to exercise Affirmer's Copyright and Related Rights in the Work (i) 0085 in all territories worldwide, (ii) for the maximum duration provided by applicable 0086 law or treaty (including future time extensions), (iii) in any current or 0087 future medium and for any number of copies, and (iv) for any purpose whatsoever, 0088 including without limitation commercial, advertising or promotional purposes 0089 (the "License"). The License shall be deemed effective as of the date CC0 0090 was applied by Affirmer to the Work. Should any part of the License for any 0091 reason be judged legally invalid or ineffective under applicable law, such 0092 partial invalidity or ineffectiveness shall not invalidate the remainder of 0093 the License, and in such case Affirmer hereby affirms that he or she will 0094 not (i) exercise any of his or her remaining Copyright and Related Rights 0095 in the Work or (ii) assert any associated claims and causes of action with 0096 respect to the Work, in either case contrary to Affirmer's express Statement 0097 of Purpose. 0098 0099 4. Limitations and Disclaimers. 0100 0101 a. No trademark or patent rights held by Affirmer are waived, abandoned, surrendered, 0102 licensed or otherwise affected by this document. 0103 0104 b. Affirmer offers the Work as-is and makes no representations or warranties 0105 of any kind concerning the Work, express, implied, statutory or otherwise, 0106 including without limitation warranties of title, merchantability, fitness 0107 for a particular purpose, non infringement, or the absence of latent or other 0108 defects, accuracy, or the present or absence of errors, whether or not discoverable, 0109 all to the greatest extent permissible under applicable law. 0110 0111 c. Affirmer disclaims responsibility for clearing rights of other persons 0112 that may apply to the Work or any use thereof, including without limitation 0113 any person's Copyright and Related Rights in the Work. Further, Affirmer disclaims 0114 responsibility for obtaining any necessary consents, permissions or other 0115 rights required for any use of the Work. 0116 0117 d. Affirmer understands and acknowledges that Creative Commons is not a party 0118 to this document and has no duty or obligation with respect to this CC0 or 0119 use of the Work.
